 WHAT IS MEDIATION?

Mediation is generally defined as the intervention in a negotiation or a conflict of an acceptable third party who has limited or no authoritative decision-making power, which assists the involved parties to voluntarily reach a mutually acceptable settlement of the issues in dispute.

In addition to addressing substantive issues, mediation may also establish or strengthen relationships of trust and respect between the parties or terminate relationships in a manner that minimizes emotional cost and psychological harm.

Somali elders learn mediation to integrate community

Confidentiality. Quality of process. Impartiality. Conflict of interest. Competence. Those were the words scribbled across the chalkboard in a St. Cloud State University classroom March 21. Beside them: I am a qualified mediator under rule 114 of the Minnesota General Rule of Practice. In three chairs — one in the middle, two facing each other — sit a middle-aged Somali man playing a 20-something college student, a St. Cloud State communications professor playing an elderly neighbor and a Conflict Resolution Center director playing a mediator.

Justin Bieber Attends Mediation Hearing On Photog’s Suit

MIAMI (CBSMiami) — Pop star Justin Bieber is in South Florida to handle his legal troubles – again. Tuesday morning Bieber’s security team swiftly and skillfully whisked him through the service entrance of a attorney’s office in a Brickell high rise so he could attend a mediation hearing on civil suit filed by freelance photographer Jeffrey Binion. He spent four and a half hours with attorneys in mediation, but ended the meeting without a settlement agreement. More depositions are set to be scheduled in the lawsuit.

Robin Williams’s Widow and Children Agree to Mediation in Estate Fight

The legal battle between Robin Williams‘s widow and his children appears to be nearing a peaceful conclusion. Attorneys for Williams’s widow, Susan Schneider, and his three children from previous marriages, squared off in probate court in San Francisco on Monday and agreed to private mediation, hoping to settle a dispute regarding the contents of his estate. Gateways and Barriers to the Widespreading of Mediation and Restorative Justice

Ignaz Semmelweiss is remembered as the 19th century physician who spotted the link between doctors washing their hands and the level of puerperal fever, which in those days could be fatal, among mothers after childbirth. He had noticed, among other things, that doctors’ wards had three times the level of infection as midwives’ wards in the hospital where he worked in Vienna. He proposed that doctors should wash their hands with a chlorinated lime solution and studies soon showed that handwashing drastically reduced the level of infection.

Reflections on Mediation: Past, Present, and Future

Forty years ago, community mediation was in its infancy in the United States.  The debut of community mediation programs had its start in part through the Law Enforcement Administration Act (LEAA) that was formed to develop new techniques and systems to strengthen law enforcement.  It was also a time when the court system was overwrought with problems like heavy caseloads and unworkable procedures and processes that simply were not delivering what was promised----due process, timely adjudication of cases and delivery of justice.

The Future of Mediation

It is impossible to talk about the future, present or past of mediation without putting some sort of definition to that term.  Clearly, mediation as dispute resolution has been around as long as disputes.  When defined as a process that involves a designated third-party to assist in the resolution of disputes, mediation is almost as old.  Village elders in remote parts of the world continue to be among the most effective mediators anywhere.
